Terms & Conditions...
By utilizing the services of PDS and by receiving chain of custody forms for drug testing, each employer, and their affiliates, officers, agents, employees, contractors, assignees and successors hereby agree to the following:
- Employer agrees to pay in full for all tests that are conducted pursuant to a chain of custody form provided to an employer by PDS for the purposes of a drug test. The employer agrees to payment in the manner the employer has selects when signing up for services. If a credit card is authorized for use, PDS may access the credit card upon transmittal of the test results. If a credit card is given as security for payment, PDS may access the credit card if payment is not received within 20 days following the billing for that test. Billing normally occurs every thirty days, although PDS reserves the right to bill within 15 days of a drug result being received by PDS.
- Employer understands that each chain of custody forms are analogous to a "blank check" that can be used for a drug test, and that therefore, the employer is responsible for all tests conducted pursuant to chain of custody forms that PDS provides to the employer..
- Employer understands and agrees that the services provided by PDS are offered for pre-employment screening services, pursuant to a written consent by the applicant. If the testing is used for any other employment related purposes, employer agrees and understand that employer should consult with an attorney or other appropriate professional to determine whether its use of the drug test is proper and legal under the circumstances.
- In the event a test has to be retaken for any reason out of the control of PDS, the collection site, a laboratory or Medical review Officer, the employer is responsible for the full cost of a new test. Where there is a positive test, or where the test is deemed inconclusive on a medical basis or any other basis out of the control of PDS, the collection site, the laboratory or Medical review Officer, it is the responsibility of the employer to pay for additional tests if requested by the employer.
- That the services offered by PDS are solely in the capacity as a Third Party Administrator. Employer acknowledges and agrees that PDS does not itself collect test samples, perform laboratory analysis, or give a medical opinions or legal opinions. However, PDS will utilize its best judgment in the selection of the laboratories and collection sites utilized for this service. As a Third Party Administrators only, Client releases, indemnifies and holds harmless PDS and its affiliates, officers, agents, directors or employees, from any liability and claims whatsoever arising out or from any alleged errors, deficiencies, or inaccuracies in the matter of drug testing/screening, or in the way or manner in which such a test sample is collected or analyzed by a collection site or laboratory, or analyzed by a medical review officered/or related in any way to any applicant or hiring decision stemming from employer’s use of PDS as a third party administrator. .Any damages are limited to the cost of the test. In the event of any dispute, all matters are subject to the laws of the State of California. In addition, any employer utilizing these services agrees to mandatory arbitration as the sole and exclusive e remedy to resolve any disputes or disagreement.
- In the event a result is challenged by a person who takes the test, the responsibility and liability of PDS is to arrange for the test taker to have the opportunity to have the sample split and examined at a laboratory of their own choice, provided that the test taker first prepays whatever customary fee is set by the laboratory for the split sample, and the name and address of the test takers laboratory is provided. PDS has no further responsibility. Client understands that any further responsibility is with the laboratory, collection site or medical review officer that is involved with the test.
- PDS does not render any opinions as to whether a person should be hired. Although PDS takes steps to assure all of its procedures are in compliance with all state and federal rules, PDS does not provide any legal services or opinions.
- PDS reserves the right to modify fees upon thirty days notice.
- client hereby agrees that it will follow all federal,state and local law that regulates drug testing, that all information will be kept confidential and private and will remain confidential, that it will be used for legal employment decisions only, and maintained privately and secure.
- All of the terms and conditions above are material to the decision by PDS to act as a third party administrator, and there can be no alteration, modifications to amendments to the above terms and conditions unless it is in writing and signed by all parties.

Price includes collection at a regular Quest colection iste. In order to make more locations available to employers, Quest has also contracted with some third party locations that are called " Quest Preferred Third Party." PDS has have received notice from Quest Diagnostic of a price increase when employers utilize these special collection sites.
As a result, any time a PDS drug testing client looks up a drug testing lab and sees the words, "Quest Preferred Third Party," please be aware that a surcharge will be added to the bill to reflect the increased cost. Because there can sometimes be delays in PDS being notified that a third-party collection site was used, there can be times when the extra fees for use of a Quest Preferred Third Party is billed later.
To determine if you are utilizing a regular Quest collation site or a "Quest Preferred Third Party," go to the Quest site to look up locations using the location tool at: http://www.questdiagnostics.com/hcp/psc/jsp/hcp_psc_index.jsp If you see the words, "Quest Preferred Third Party," then the extra fee applies.
In addition, there are times that an PDS drug testing client will need a location that is not in he Quest system. PDS will work to find a hospital, medical office or some other site that can accommodate these special testing needs. However, there will be an additional surcharge called an, " Extended Network Collection Fee." Because the Extended Network Collation fees are completely outside of the normal PDS system, there is no way to list the fees in advance. This fee may also be billed after the test. If there is a question about such special fees, contact your PDS drug testing representative.
